Our judiciary originally setup by imperialist Britain, never tires of quoting from British laws, traditions and conventions. Now something opposite has happened in Swamy case.

The court said, "It is not a European country like Britain. We have diversity and we should be proud of it. If you (Swamy) give an undertaking that you will not write anything based on the book, I will grant you the relief," the judge said.

Is the court agreeing that Britain is not secular? If so, why to emulate their communal system? why to continue with their system of judiciary alien to this country?

Delivering the judgment, a Bench of Justices Markandey Katju and Gyan Sudha said: “In our opinion, honour killings, for whatever reason, come within the category of rarest of rare cases deserving death punishment".

Now have this -

Writing the judgment, Justice Katju said: “‘Honour' killings have become commonplace in many parts of the country, particularly in Haryana, western Uttar Pradesh, and Rajasthan".

That means the honour killings are not actually rarest of the rare but they are to be considered as rarest of the rare. These judges certainly need a lesson in logic. Do they have any logical aptitude test for recruitment of judges?!

Why not accept that the earlier judgement of Supreme Court which laid down the rule of ‘death sentence only in rarest of the rare case’ was wrong and apologise to the nation?

On the issue of separatists holding a seminar in the Capital, one channel (NDTV?) uses the word 'Azadi' instead of 'sedition'. Instead of condemning the separatists, it condemns nationalists by accusing BJP of trying to 'cash-in' for opposing the seminar. Is it not the duty of the main opposition party to raise its voice when govt is soft on anti-nationals? It seeks to justify the seminar by saying that 'Gelani was always saying that in Kashmir'.

Lawyers's violence: Judicial Solidarity

Judges come from the lawyer community. Here is the Supreme Court's attitude towards Chennai High Court violence:

"Who permitted the police to enter the court premises?".
It defies logic. When the Police station is existing inside the High Court premises, where is the question of taking permission to enter the court?

"Police officers whose names 'cropped up' for the violence to be transferred pending an enquiry."
Why not debar the lawyers whose names "cropped up" pending an enquiry?
When some lawyers indulged in violence inside a court room, why can't they be summarily arrested?

As per the state solicitor general 122 police/fire personnel and 77 advocates were injured in the violence. So, who indulged in more violence? The police are supposed to be violent by nature and the lawyers are supposed to be peaceful!

"The Chief Justice asked the lawyers to call off strike by March 2".
Why not immediately?

"Retired Justice Srikrishna to probe HC clash".
Is it the same srikrishna who gave a report against bombay police?

"The Bench asked the enquiry panel to consider action against officers who allowed the police to enter the court".
So, the outcome of the inquiry is predetermined.
Where is the need to replace the inquiry ordered by High Court with that of an inquiry ordered by Supreme Court? Is it to give it sense of finality?

It is appalling that the judges don't feel ashamed of their lawyer brothers. Obviously the supreme court judges don't realise the enormous significance of being on the Dharmasana of this great ancient land.

It appears that Justice Srikrishna has given a reasonable report. The lawyers' violence was so indefensible.

NDTV could not stomach death sentences given to blast accused by Justice Kode. Instead of reporting the announcement of death sentences (on one of those days) as a news item, it reported -blast accused punished but not the riot accused!

It was a clear attempt to discredit the judgement, as the two crimes are qualitatively different.

NDTV also followed it up with a discussion today (8pm to 9pm). The program titled 'whether the punishment given to Sanjay was too harsh', was actually used to raise the issue of Bombay riots and discredit the blasts judgement. During the discussion, when specific questions were raised against the police, the police officer sitting there was not allowed to reply immediately. Instead, wide ranging questions were allowed to pile up, so that they can not be wholly answered. And finally when the police officer was allowed to answer it was for too short a time, and during that too the loud-mouthed seetalvad was allowed to interfere (by burkha dutt).

NDTV once again proved that it is a terrorist frontend.

On issue of attack on periyar statue it is reported (see link above) -'Karunanidhi suspected that the statue must have been damaged by “a community that feared that it will lose its dominance over society if all Tamils gained self respect.”'

The obvious reference is to brahmins. He also failed to condemn the attack on Ganesha statue and the priest's (though he is the CM of the state). Meanwhile the Tamilnadu brahmin association clarified that brahmins were in no way responsible for the attack on periyar statue.

On 6th May NDTV's 'we the people' program was discussing 'encounters' in the background of Gujarat encounter. All questions raised by the anchor (burkha dutt) were intended to generate sympathy for terrorists, and demonise the police and the middle class public who are still concerned about national interest. Even though the topic has relevance to national security, the idea of national interest was not even mentioned once by Burkha Dutt. Kerala HC (Js KS Radhakrishnan and Js MN Krishnan) took a tough stand against minister muhammedkutty for abusing the judiciary, and rejected the escapist apology from him. It is unlike the Madras HC which developed cold feet, after taking objection to the remarks of one minister (veeraswamy?) supported by CM karunanidhi, closed the case without even a simple apology from the contemner. Of course, the judges can not be faulted, as they were dealing with the mighty karunanindhi who can even indulge in contempt of Supreme Court by calling for a bandh against its judgement.
